Here's how it was explained to me, fwiw.

It’s an interesting question/comparative, indeed between all 3 of the Spanish clubs –Barcelona & the 2 Madrid’s TBH. Essentially Real seemingly learnt a lot form Barcelona’s case, managing to take the arbitration in to a defined territory that would favour their agenda (IE: Ensured their case would be reviewed by only 1 judge, rather than the usual 3) and reduced the amount of claims from 9 serious infractions, to only 1.

Equally within this they used testimony from certain parents of said affected players (the Zidane’s ironically enough, or Takuhiro Nakai’s) to show their living situation was not directly related to any potentially perceived trafficking. As well as quickly regulating all the paperwork within their youth structure to support this. Atleti’ from what I understand behaved slightly differently admitting some negligence, at least initially that is.

This notwithstanding perhaps most importantly was the fact that the Spanish Federation testified in favour of Madrid in their case. Claiming their youth teams are in essence a non-profit structure, without any ulterior business motivations (+ an expert in employment law testifying similarly) I do not agree with this point in particular. Perhaps (un)surprisingly Dr. Lowe hasn’t covered this subject yet, as it would be intriguing to read his “spin” on it.
